TERMS + CONDITIONS:

Verde Organic Body, LLC and its owners, members, managers, directors, officers, employees, instructors, therapists, trainers, or agents are hereafter collectively referred to as the “Wellness Practice”.

By signing this document, I am declaring that I am in physically sound condition and to participate in Wellness Practice services, and that I have informed the Wellness Practice of any injuries, allergies, medications, or other medical information that may be pertinent to me receiving services or at the Wellness Practice, and have completed this health history form completely and to the best of my ability. I also know that if I choose to withhold pertinent medical information from the Wellness Practice, that I will not hold the Wellness Practice liable for any reactions or injuries I may sustain. I declare that I will not sue the Wellness Practice in the event of

injury. I hereby release the Wellness Practice, and all owners, members, managers, operators, directors, officers, employees, instructors, therapists, trainers, and agents of all claims, costs, demands, expenses, and causes of action should I not mention something on this form and that condition is aggravated at any time.

In the event of a Medical Emergency, I hereby give the Wellness Practice staff permission to call 911 or request an ambulance or aid car to transport me to an emergency center for treatment. The Wellness Practice will also have permission to contact my emergency contact at this time. I further consent that the Wellness Practice may disclose any medical information that I have provided to them to any medical responders and/or medical practitioners at the time of the call, that may be deemed necessary in the sole discretion of the Wellness Practice.

I understand and agree by signing this document that I agree to abide by all policies and procedures of the Wellness Practice. I also understand that if I do not abide by all policies, protocols and procedures put in place by the Wellness Practice, the Wellness Practice has the right to terminate any/all memberships and/or appointments that I may have, with no guarantee of reimbursement or refund.

I understand that by signing this document that I am aware of the cancellation policy at the Wellness Practice. I understand that to avoid a fee when cancelling an appointment of any kind at Wellness Practice, that I will need to provide notice as listed on the Wellness Practice website. I understand that any cancellations or contract terminations may be subject to a cancellation fee, to be automatically charged to my credit/debit card on file, or the forfeiture of a prepaid session on the account. I also understand that all sales are final.


WAIVER OF LIABILITY

he Wellness Practice is not liable for any injury or loss of property occurring while I am a participant in Wellness Practice activities, using equipment, getting therapy or services, or on the Wellness Practice’s premises, for any reason whatsoever, including negligence on the part of the Wellness Practice.

In consideration of my being able to use the Wellness Practice’s facilities I release the Wellness Practice from all liability to me for any loss or damage done to my personal property while on premises, including the studio space and parking lots. In consideration of my being able to use the Wellness Practice facilities, I hereby release the Wellness Practice from any and all present and future claims resulting from negligence on the part of the Wellness Practice for loss, damage, or theft of personal property, personal injury, or death arising as a result of using the facilities or any activities incidental thereto, wherever, whenever, or however the same may occur. I am voluntarily participating in the Wellness practice activities with knowledge of the dangers involved and herby agree to accept any and all inherent risks of property damage, personal injury, or death. I hereby voluntary waive any and all claims resulting from both negligence, both present and future, that may be made by me, my family, heirs or assigns.

I hereby release them from any and all present and future claims resulting from negligence on the part of the Wellness Practice for loss, damage, or theft of personal property, personal injury, or death arising as a result of using the facilities or any activities incidental thereto, wherever, whenever, or however the same may occur. I further agree to identify and hold harmless the Wellness Practice from all claims arising as a result of my engaging in Wellness Practice activities or any activities incidental thereto, wherever, whenever, or however the same occur. I understand that this Waiver is intended to be as broad and inclusive as permitted by the laws of Washington and agree that if any portion is held invalid the remainder of the Waiver will continue in full legal force and effect. I further affirm that the venue for any legal proceedings shall be in King County, Washington. I affirm that I am of legal age and by signing this Waiver, I have read this waiver and I agree with the terms and conditions of this waiver. By signing this Waiver, I am giving up legal rights and/or remedies that may be available to me for the negligence of Wellness Practice .

VERDE STUDIO POLICIES + TERMS AGREEMENT:


GENERAL STUDIO POLICIES

All clients must register a valid VERDE MindBody client account, including a valid debit or credit card on file to reserve and book appointments and services. All clients must complete health history intake form, liability waiver, studio policy agreement, and any subsequent required documentation for participate in, or receive any of our services. Gift Cards DO NOT replace a valid credit/debit card on file required to make appointment reservations, no exceptions. All clients are responsible for disclosing health and medical conditions to studio staff (trainers, therapists, instructors) that includes but not limited to injuries, allergies, medications, or other medical information that may be pertinent to when receiving services or participating in training or classes at our studio. If clients choose to withhold pertinent medical information from studio staff, and VERDE and it's employees will not be held liable for any reactions or injuries that are sustained. 


MASSAGE

All Massage Therapy sessions must be scheduled in advance, through our front desk, website or the VERDE Organic Body App. All Massage appointments sessions must be cancelled or rescheduled with a minimum of 24 hours notice. Failure to provide ample notice may result in forfeiture of prepaid sessions or a cancellation fee, regardless of reason or cause, as outlined below, charged to the card on file. No-Showing to any scheduled massage appointment is considered a late cancellation and may result in a cancellation fee or forfeiture of a prepaid session.


Massage appointments must be scheduled in advance. Massage appointments can be scheduled same day, and can be scheduled in person, by phone, by text, through our website, or via the VERDE Organic Body App. Massage Memberships are charged on the 1st or 15th of each month. Any unused prepaid sessions on the account will continue to roll over and will not expire as long as the client is an active Massage member. Client with active autopay memberships will receive member rate on all additional massage sessions outside of the prepaid sessions each month, for the duration of the active membership. VERDE offers non-discounted rates for individual sessions as well as packages for a discounted rate for all non-member clients. Membership Massage Sessions expire 60 days after final payment date when membership is cancelled.


SAUNA

All Sauna sessions must be scheduled in advance, through our front desk, website or the VERDE Organic Body App. All Sauna appointments sessions must be cancelled or rescheduled with a minimum of 24 hours notice. Failure to provide ample notice may result in forfeiture of prepaid sessions or a cancellation fee, regardless of reason or cause, as outlined below, charged to the card on file. No-Showing to any scheduled sauna appointment is considered a late cancellation and will result in a cancellation fee or forfeiture of a prepaid session.


Sauna appointments must be scheduled in advance. Sauna appointments can be scheduled same day, and can be scheduled in person, by phone, by text, through our website, or via the VERDE Organic Body App. Sauna Memberships are charged on the 1st or 15th of each month. Client with active autopay memberships will receive member rate on all additional massage sessions outside of the prepaid sessions each month, for the duration of the active membership. VERDE offers non-discounted rates for individual sessions as well as packages for a discounted rate for all non-member clients. Membership Sauna Sessions expire 40 days after final payment date when membership is cancelled.


PERSONAL TRAINING

All Personal Training sessions must be scheduled in advance, through our front desk, website or the VERDE Organic Body App. Our studio has a 24 hour late-notice cancellation policy, and any personal training sessions must be cancelled or rescheduled with a minimum of 24 hours notice. Any cancellation with less than 24 hours notice may be subject to a late-notice cancellation fee automatically charged to the card on file, or automatic forfeiture of prepaid session on file. Late cancels are usually given a 48 hour grace reschedule, with the same trainer initially scheduled, for the client's benefit. No-Showing to any scheduled personal training appointment is considered a late cancellation and will result in an automatic cancellation fee charge or automatic forfeiture of a prepaid session.


Personal training appointments must be scheduled in advance, and paid in full prior to first training session date. All personal training sessions are semi-private with up to 2 clients per 1 trainer. Personal training memberships are charged on the 1st or 15th of each month for 4 weeks worth of sessions at $59 per session. Personal training memberships are designed on a 4 week schedule, and additional sessions may be required for purchase at member rate of $59 for long months that extend past 4 weeks. Reserved Personal Training membership contracts are 3 month contracts that auto- renew every 3 months. Reserved Personal Training membership sessions expire within 45 days, and sessions can be rescheduled in advance with more than 24 hours notice, with any trainer at any time, within the session expiration time frame of 45 days. VERDE Organic Body does not guarantee availability for sessions that are rescheduled outside of their initial reserved time slot. To cancel a Person Training membership, client must provide a minimum of 30 days in studio notice with the studio provided form. Any membership cancellations made prior to the 3 month contracted end date of the contract are subject to an early termination fee. VERDE offers individual sessions ($89/session) and 4 packs ($69/session), for all non- member clients. Individual personal training sessions and 4 pack personal training sessions will be scheduled out once purchase has been made for the number of sessions that are pre-purchased, and sessions expire 12 months after the date of purchase. 


OPEN GYM

All Open Gym sessions must be scheduled in advance, through our front desk, website or the VERDE Organic Body App. Our studio has a 24 hour late-notice cancellation policy, and any Open Gym sessions must be cancelled or rescheduled with a minimum of 24 hours notice. Any cancellation with less than 24 hours notice may be subject to a late-notice cancellation fee automatically charged to the card on file, or automatic forfeiture of prepaid session on file.


CLASSES

All Class sessions must be scheduled in advance, through our front desk, website or the VERDE Organic Body App. Our studio has a 24 hour late-notice cancellation policy, and any sessions must be cancelled or rescheduled with a minimum of 24 hours notice. Any cancellation with less than 24 hours notice will be subject to a late-notice cancellation fee automatically charged to the card on file, or automatic forfeiture of prepaid session on file. Clients are required to arrive to Class Sessions on time, and will not be permitted access to class once class session has started. Class Session start time is defined as the listed time format, for example 9:00am. If a client arrives late to a Class Session, it will be considered as a late arrival, without guarantee of refund and client will forfeit the pre-purchased session.


HEALTH INTAKE FORMS + STUDIO POLICIES AGREEMENT

All clients are required to complete and sign VERDE Organic Body’s health history intake form, liability waiver, studio policy agreement, and any subsequent required documentation for participate in, or receive any of our services. Failure to complete required forms prior to the scheduled service may result in refusal of service, without prior notification, and client may be held financially responsible for the full cost of the session time reserved. 


MEMBERSHIP/AUTO-PAY CANCELLATION + HOLD POLICIES

All payments dates are either the 1st or the 15th of each month, and we will charge the card on file automatically on these dates for the cost of your membership or auto-pay as detailed in written contract completed and signed by each client. We require in 30 days in studio notice to cancel any month to month memberships or auto-pays. Auto-pay membership sales are final and non- refundable. Clients are responsible to be aware and adhere to our 30 day in-studio notice required for membership cancellation and/or holds, and an physical cancellation form document must be completed in-person/in-writing to be considered notice of cancellation or hold. 


Membership Cancellation Session Expiration Policy: When a client cancels an auto-pay membership, any un-used sessions on the account will remain active on the account for up to 60 days following the membership final payment date, and un-used sessions must be used within 60 days of membership cancellation date. Any sessions remaining on the client account after 60 days of membership cancellation will be forfeit. 


GENERAL MINOR PARTICIPATION

All clients under the age of 18 will need a minor consent form signed by a legal parent and/or guardian prior to participating in or receiving services at Verde. All persons under the age of 16 must have a legal parent and/or guardian present while the service is taking place. Failure to have a legal parent and/or guardian present may result in refusal of service, without prior notification, and client may be held financially responsible for the full cost of the session time reserved. 


MINOR MASSAGE PARTICIPATION

Minimum age requirement for massage is 12. All persons under the age of 16 may be required a parent present in the treatment room, or in reception area, during massage session. 


MINOR TRAINING PARTICIPATION

Minimum age requirement for personal training is 16. All persons under the age of 18 may be required to have a parent present in the fitness studio, or reception area, during Personal Training, and is required for or VIP Open Gym sessions. 


MINOR YOGA PARTICIPATION

Minimum age requirement for yoga is 12. All persons under the age of 16 must have a parent present in the fitness studio, or reception area, during yoga session. 


PRENATAL + ONCOLOGY CONSENT

All clients who are pregnant or who are diagnosed/have recently had active cancer must complete a prenatal or oncology intake form prior to participation in or reception of any VERDE services. Both the prenatal and oncology intake forms need to be completed and signed prior to participation in services. Failure to inform the studio and complete the needed forms prior to the scheduled service may result in refusal of service, without prior notification, and client may be held financially responsible for the full cost of the session time reserved. 


EMAIL OPT-IN, CLIENT ACCOUNT INFORMATION + COMMUNICATION

All clients are required to complete and sign VERDE Organic Body’s health history intake form, liability waiver, studio policy agreement, and any subsequent required documentation for participate in, or receive any of our services. Failure to complete required forms prior to the scheduled service may result in refusal of service, without prior notification, and client may be held financially responsible for the full cost of the session time reserved. We highly recommend but cannot require our clients to opt-in to automated account email communication within our client profile management system. VERDE Organic Body does not guarantee the accuracy or validity or accuracy of client submitted emails or phone numbers that are entered incorrectly or inaccurately into our client management system. In the event that a client does not enter a valid email or phone contact information into studio required client profile, VERDE Organic Body is not held responsible or liable for failure to deliver written or phone account or appointment reservation notification to client due to inaccurate or invalid information provided. It is the client's responsibility and agreement to obtain, maintain and be held responsible for collecting and all information regarding their client account, including but not limited to membership status, autopay contract status, session reservation status and transaction history for their personal records. 


PHOTO POLICY

VERDE Organic Body reserves the right to take and use photos and videos from VERDE held at public studio events for any/all marketing campaigns used on sites or social media accounts run by VERDE, without limitation or obligation. If you wish to exclude yourself from photo participation, please communicate this to any event photographer at time of event, or simply remove yourself from any photo participation. This is included in our liability waiver, and must be agreed to for participation in services at VERDE. 


LOST PROPERTY

All lost property at VERDE is kept at the studio for two weeks. After two weeks have passed, all lost items will be removed from the studio and donated. If you know that you have lost something at VERDE, you are required to contact the front desk in writing via email info@verdeorganicbody.com. Any confirmed/identified lost client items will be set aside/held for two weeks, requiring in-person client pickup. 


GIFT CARDS

Gift cards must be purchased for the service you would like to gift, and cannot be transferred to other services, no exceptions. Gift Cards DO NOT replace a valid credit/debit card on file required to make appointment reservations, no exceptions. 


ALL SALES ARE FINAL AND ARE NON-REFUNDABLE.VERDE ORGANIC BODY RESERVES THE RIGHT TO CHANGE ANY OF THE ABOVE POLICIES AT ANY TIME. 


I understand and agree by signing this document that I agree to abide by all policies and procedures of the Wellness Practice. I also understand that if I do not abide by all policies, protocols and procedures put in place by the Wellness Practice, the Wellness Practice has the right to terminate any/all memberships and/or appointments that I may have, with no guarantee of reimbursement or refund.
